Ghaziabad: The UP government has asked development authorities to prepare a list of builders who have handed over flats to buyers on the basis of occupation certificates but without registration.
This has caused huge loss to the state exchequer in terms of stamp duty, officials said. Section 13 of the UP Apartment Act and the provisions of the Stamp Act, 1899, make it mandatory for any developer to register their flats before handing over possession.
“But many builders, who have obtained occupancy and completion certificates, are handing over flats through sale agreements despite their registries being pending. The government is losing a lot of money in this way. According to an estimate Nearly 600 flats in Ghaziabad were handed over to owners without registry, causing a loss of Rs 12,000 crore. In 2018, the district administration lodged FIRs against three developers for failing to register flats and properties with the government even after receiving full payment from buyers and handing over possession.
Ashish Kumar, a home buyer, alleged that the developers had ill intentions in delaying the registration of the flats.
“This is because a developer has to maintain the society until most of it is registered with the government, charge hefty sums from residents and make profits. Once the registration is done, the AOA Or the RWA takes over the maintenance of the society. They also make profit from the inflated electricity bills and supply it to the residents at a higher rate, but after registration, the buyer gets the same. One gets ownership rights,” said Ashish Kumar, a home buyer.
