The court on Monday was hearing a plea filed by an actor and dancer who, following a matrimonial dispute with her husband, started living in a flat in Tollygunge, which she claims she is the co-owner of but which her husband fraudulently acquired. Co-ownership was transferred. To his sister.
She alleged that her husband and in-laws tortured her physically and mentally. Her lawyer told the court that CCTV cameras were installed in the flat and also outside her bedroom in another flat in her marital home, Bertola.
The petitioner had alleged that she and her husband had purchased the Tollygunge studio apartment and she believed that it was in both of their names. She said she later learned that her husband had fraudulently transferred the property in his sister’s name. She alleged that her in-laws had cheated her in terms of both “property and marital rights”.
The husband’s lawyer repeatedly pointed out that the sister had possession of the property, and therefore, she could install cameras. But Tollygunge police filed a report stating that the petitioner was in possession.
“You have your property; I am not interfering in it,” Justice Tirthankar Ghosh said. “CCTV involves the person’s permission. You cannot violate confidentiality… The report from Tollygunge police station shows that it (the Tollygunge property) is in possession.”
However, Justice Ghosh clarified that the order was only for Tollygunge flat and not for Bertola House, as the petitioner mostly lives at the former property.
